Concerns have been raised about a constitutional challenge being mounted in B.C.'s highest court against the province's impaired driving penalties.
Three days worth of arguments were slated to start today, but the B.C. Court of Appeal has adjourned the case until administrative procedures can be clarified.
Lead justice Catherine Ryan says this case is a “mess” and she doesn't think it can proceed before three other disputes are resolved.
She's hosting a pre-trial conference tomorrow to determine if arguments can proceed this week.
The legislation was initially challenged in 2011 when a lower court judge ruled it was unconstitutional because there was no proper way for drivers to dispute police findings.
