The judge overseeing the criminal negligence causing death trial of former BC Ferries officer Karl Lilgert is now delivering her instructions to the 12-member jury.
BC Supreme Court Justice Sunni Stromberg-Stein is expected to spend the entire day explaining what evidence can be considered.
She started by telling jurors they are the judges of the facts, while she is responsible for the law.
She says they must consider the evidence against Lilgert 'without sympathy, prejudice or fear' and they must unanimously agree on his guilt in order for him to be convicted.
The 59-year old is accused of causing the fatal sinking of the Queen of the North in 2006 because he was distracted for several minutes before the ship ran aground and sank.
The judge says, while the jury can consider evidence of a sexual relationship with his co-worker Karen Briker interfering with his duties, they can not use that to judge his 'character.'
