At least one B.C. electoral battle is going to court.
As Elections BC continues to count ballots from the 40th provincial general election, the agency has called for a judicial recount in the riding of Coquitlam-Maillardville where New Democrat Selena Robinson now leads Liberal Steve Kim by only 35 votes.
"The total votes that separate the top two candidates is 35, and the threshold is 43, therefore a judicial recount must be conducted in accordance with the election act,” says spokesman Don Main.
It'll be up to a BC Supreme Court judge to determine when that recount will be held.
Main says he's not aware of any other ridings that may follow suit.
"There are six different categories of ballots that are being counted and they have a candidate and possibly a representative there watching every single step of the way, and it all has to be counted, each one, appropriately."
Meanwhile, New Democrat David Eby claims official victory in Vancouver-Point Grey over Premier Christy Clark with just more than 1,000 votes.
In its latest update, the agency says the NDP has extended its lead in Saanich North and the Islands to 92 votes, compared to 52 on Election Day, with a reported 1,500 votes still left to count.
As of 4:30 p.m. Tuesday, the counting is complete in 60 ridings, with 24 still in progress.
Further updates on counts of absentee ballots come Wednesday at noon and 430 p.m.
