Rioter Spencer Kirkwood, who said he was too drunk to remember participating in the Stanley Cup riot, will not be going to jail.
Vancouver Provincial Court judge Connie Bagnall sentenced the 26 year old to a 30 day conditional sentence, plus two years probation for his part in the riot caught on video.
The crown and defence both agreed that a 30 to 45 day sentence was appropriate but the crown asked for jail, while the defence wanted time served in the community.
