A Vancouver man who killed the 2-year old daughter of his common-law spouse is now trying to get Canada's highest court to overturn his conviction.
David Carl Sunshine was found guilty of second-degree murder for the death of Isabella Rain-Ayala in December of 2005.
During an undercover RCMP investigation, he admitted he punched the toddler several times and burned her with a lighter, but at his trial, his lawyer argued the death was not intentional.
He was sentenced to life in prison with no chance of parole for 15 years.
In March, the BC Court of Appeal rejected claims the trial judge failed to properly instruct the jury, but sunshine is now seeking a ruling from the Supreme Court of Canada.
