Driver in civil case argues girl wasn't taught how to cross street properly

An Abbotsford woman has been found liable for a car crash in which she hit a 10-year-old girl near a school.

A few weeks after classes started in 2006, Kyla Taggart was leaving Centennial Park Elementary for the day.

She tried to cross Gladwin Road in an unmarked crosswalk, but was hit by a Mercedes SUV.

The 75-year-old driver, Elly Heuchert, denied being at fault, saying, in part, Kyla’s mother didn't teach her child how to cross the street properly.

The judge acknowledged Kyla should have walked a little slower, but said Heuchert did not have the right of way, wasn't paying attention to that side of the street, and should have slowed down with the other cars.
