The mining company embroiled in a controversy over hiring temporary foreign workers for a mine in Tumbler Ridge, B.C., is appealing a court decision that sides with the unions.
A federal court has granted standing to two unions in a case that will review the permits surrounding the Chinese workers – who the unions say should be replaced with Canadian workers.
Jody Shimkus, vice-president with HD Mining, defends her company, but doesn't say much.
"I don't intend to comment on the decision but I will say that we continue to participate along with the federal government to oppose that application."
In its appeal, HD Mining claims Human Resources Minister Diane Finley shouldn't have voiced her concerns about the Temporary Foreign Worker Program after legal action was filed earlier this month.
The company continues to insist the Chinese workers were only hired after attempts to find skilled Canadians failed.
